Terms of Service
Please read these terms before using DeFrame Art. They explain what you can expect from us and what we ask of you in return.

These Terms of Service ("Terms") govern your use of the DeFrame Art website at deframeart.com and our mobile application (collectively, the "Service"), operated by DeFrame Art ("DeFrame," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this age requirement. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
2. Your Account
When you create an account, you agree to provide accurate information and to keep it up to date. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify us immediately at hello@deframeart.com if you suspect unauthorized access to your account.
You may not create an account on behalf of someone else, use a false identity, or share your login credentials with others.
3. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Use the Service in any way that violates applicable laws or regulations.
- Attempt to gain unauthorized access to any part of the Service or its infrastructure.
- Scrape, crawl, or extract data from the Service by automated means without our prior written consent.
- Transmit spam, malware, or any harmful or disruptive code.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Use the Service to harass, abuse, or harm any person.
- Interfere with the proper functioning of the Service or the servers and networks that support it.
4. User-Generated Content
The Service allows you to save artworks and articles to personal collections and to submit questions through the DeFrame AI feature. You are solely responsible for any content you submit. You represent that you have all necessary rights to submit that content and that doing so does not violate any third-party rights or applicable law.
By submitting content to the Service, you grant DeFrame a non-exclusive, worldwide, royalty-free license to use, display, and store that content solely to provide and improve the Service. We do not claim ownership of your content.
5. DeFrame AI Feature
The "Ask DeFrame" AI feature is provided for informational and educational purposes only. Responses are generated by a large language model and may contain inaccuracies. You should not rely on AI-generated responses as professional advice in any field.
Questions you submit to the AI feature are processed by OpenAI's API. Do not include personal, sensitive, or confidential information in your questions.
6. Intellectual Property
All content on the Service created by DeFrame — including editorial text, original artwork descriptions, the DeFrame Art logo, and the overall look and feel of the site — is owned by DeFrame Art and protected by copyright and other intellectual property laws.
Artwork images displayed on the Service are reproductions of public domain works or are used under license or fair use. Artist names, artwork titles, and biographical information are factual and not subject to copyright claim by DeFrame.
You may not reproduce, distribute, or create derivative works from DeFrame's original content without our prior written permission.
7. Third-Party Links and Content
The Service may contain links to third-party websites or services, including museum websites and ticketing platforms. These links are provided for convenience only. DeFrame has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party sites. We encourage you to review the terms and privacy policies of any third-party sites you visit.
8. Disclaimers
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. To the fullest extent permitted by law, DeFrame disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Venue listings, event information, and exhibition details are provided for general guidance only. Always verify details directly with the relevant venue before making travel or ticketing decisions.
9. Limitation of Liability
To the fullest extent permitted by applicable law, DeFrame Art shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
In no event shall DeFrame's total liability to you for all claims exceed the greater of (a) the amount you paid to use the Service in the 12 months preceding the claim, or (b) USD $50.
10. Indemnification
You agree to indemnify, defend, and hold harmless DeFrame Art and its team members from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any third-party rights.
11. Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms or if doing so is necessary to protect the Service, our users, or third parties.
You may close your account at any time by contacting us at hello@deframeart.com. Upon termination, your right to use the Service ceases immediately.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we may notify you by email or via a notice on the Service. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict-of-law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in California, and you consent to the exclusive jurisdiction of those courts.
